These Terms & Conditions apply to all products and services supplied by Nurse Call Direct ("we", "our" or "us").

By purchasing products or using this website, the customer agrees to these Terms & Conditions.

Nurse Call Direct is an authorised reseller of Chip Development Pty Ltd products, including CareBell nurse call peripherals and related equipment.

Pricing

All prices displayed on this website, quotations, invoices or other documents are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.

GST will be added where applicable in accordance with Australian taxation laws.

Prices may change without prior notice.

Payment Terms

Payment is required prior to dispatch unless an approved trading account or written credit arrangement has been established.

Ownership of all goods remains with Nurse Call Direct until full payment has been received and cleared.

We reserve the right to suspend or cancel supply where payment obligations are not met.

Product Availability

All orders are subject to product availability.

Where stock is unavailable at the time of order, products may be placed on backorder and supplied once stock becomes available unless otherwise requested by the customer.

Nurse Call Direct shall not be liable for any loss, delay, expense or damages arising from stock shortages, delayed supply or discontinued products.

Product Specifications

Manufacturers may update or modify product specifications, packaging, appearance or technical features without prior notice as part of ongoing product improvements.

Images, drawings and product descriptions on this website are provided for general illustration purposes only and may vary slightly from supplied products.

Deliveries

Delivery charges may apply to all orders. Standard shipping is $20.00 AUD. Free shipping applies to orders over $500.00 AUD.

Estimated delivery times are provided as a guide only and are not guaranteed.

Nurse Call Direct shall not be responsible for delivery delays caused by freight providers, supplier delays, weather events, industrial action, customs delays or circumstances beyond our reasonable control.

Risk in the goods passes to the customer upon delivery.

Claims & Damaged Goods

Any claim relating to incorrect supply, damaged goods or shortages must be made within 7 days of delivery.

Claims relating to non-delivery must be submitted within 30 days from the invoice date.

Products that have been installed, modified, physically damaged or improperly used after delivery may not qualify for replacement, refund or credit.

Nothing in this clause limits any rights or remedies available under Australian Consumer Law.

Returns

Returns are accepted only with prior written approval from Nurse Call Direct.

Approved returns may be subject to inspection and a restocking fee.

Special-order items, custom-made products, used products or opened electrical items may not be eligible for return unless required under Australian Consumer Law.

Warranty

Products supplied by Nurse Call Direct are covered by the applicable manufacturer's warranty where provided.

Warranty does not cover:

  • Incorrect installation
  • Improper use or misuse
  • Physical damage
  • Water or liquid ingress
  • Power surges or electrical faults
  • Unauthorised repairs or modifications
  • Normal wear and tear
  • Damage caused by incompatible third-party equipment or systems

Customers are responsible for ensuring products are suitable for their intended application and compatible with their existing systems.

All installations should be carried out by suitably qualified personnel where required.

Australian Consumer Law Notice

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Limitation of Liability

To the maximum extent permitted by law:

  • Nurse Call Direct shall not be liable for any indirect, consequential, incidental or special loss or damage including loss of profits, business interruption, loss of revenue, loss of contracts, loss of data or downtime arising from the supply, installation, use or inability to use any product or service supplied by us.
  • Nurse Call Direct shall not be liable for delays, non-delivery or product unavailability caused directly or indirectly by events outside our reasonable control.
  • Products supplied by Nurse Call Direct are intended to assist care and monitoring systems only and must not be relied upon as the sole means of patient supervision, emergency response or life protection.
  • Nurse Call Direct accepts no responsibility for losses arising from incorrect installation, misuse, system incompatibility, unauthorised modification or failure of third-party systems or equipment.
  • The customer is responsible for ensuring all products are correctly installed, tested and maintained in accordance with manufacturer recommendations and applicable standards.
  • Our total liability for any claim, loss, damage or expense relating to products or services supplied by Nurse Call Direct is strictly limited to the amount actually paid by the customer to Nurse Call Direct for the specific product or service giving rise to the claim.

Nothing in these Terms excludes, restricts or modifies any rights or guarantees that cannot legally be excluded under Australian Consumer Law, including applicable consumer guarantees relating to goods and services.

Intellectual Property

All trademarks, logos, product names, technical documentation, product designs and branding relating to CareBell products remain the property of Chip Development Pty Ltd or their respective owners.

No content, material or information from this website may be copied, reproduced, modified or distributed without prior written permission.

Privacy

Nurse Call Direct respects your privacy and handles personal information in accordance with applicable Australian privacy laws.

Information provided to us may be used for order processing, freight arrangements, customer support, warranty handling and related business operations.

We do not sell or disclose customer information to unrelated third parties except where required to fulfil services or comply with legal obligations.

Website Information

While reasonable efforts are made to ensure information on this website is accurate, Nurse Call Direct does not guarantee that all website content is complete, current or error-free.

Technical information, specifications and compatibility information should be independently verified by the customer before purchase or installation.

Governing Law

These Terms & Conditions are governed by the laws of the State of Victoria, Australia.
